Owner shop wanted to recover arrears of rent

The court in Amsterdam today has a bankruptcy petition of V &. D by shop owner Komen rejected Realty Heerhugowaard. The owner of the V & D subsidiary in Daman tried as yet arrears to recover.



But the court finds that V & amp; D not ceased to pay now that the rents in a depot is deposited with a notary. V & D with nearly all of its landlords agreed to a rent discount, it was agreed that it will not pay part of the rent in a depot. Under certain conditions, this money still be paid to the tenants. Come Realty did not sign the agreement and does not consider itself bound there.

The court, however, that the department store chain has demonstrated sufficiently that in February, a refinancing, and thus is able to meet all its obligations. Also has V & D still has a credit facility of EUR 25 million.

Still pay
The Decision also shows that V & D in the matter has committed Komen Properties to pay yet, as the ongoing summary proceedings of landlords and Mondia Metro Prop lose. Mondia owns the shop in Hengelo. Metro Prop owns subsidiaries in Den Bosch, Heerlen and Sittard. Even those owners require full payment of rent by V & D.

The lawsuit between V & D and Metro Prop Wednesday arrested two weeks. Both parties have the opportunity to get out there together. They do not succeed within fourteen days, the judge in Den Bosch will still ruling. In the lawsuit Mondia is expected next week ruled.
