The administrative jurisdiction Division of the Council of State, the highest administrative judge in the Netherlands, that Wednesday is determined in a case that association SlijtersUnie had instituted against several municipalities. Against the judgment no appeal is possible.
In the wake of the district court of Oost-Brabant, also ruled the Council of State that the Drink – and Horecawet is violated at the time that there is no supervisor present.
SlijtersUnie is thus vindicated. The organization had the mayors of Sint-Oedenrode, the netherlands, Someren and Schijndel asked to take measures against three liquor stores in local supermarkets. The shops did not have permanent managers who are overseeing the drankafdeling.
According to the mayors, this was also not necessary, because the supermarket and the liquor store, according to them, a common ‘design’.
One supervisor for the entire store would be adequate. The Council of State designates the liquor store, however, if a separate space in which a supervisor must be present.
