The lawsuit centered on entrepreneurs in their retail space a collection point PostNL. As of July 1, PostNL has adapted the remuneration model for these retailers. The fees received about 2,500 retailers reduced for handling mail and packages.
VVP wanted to force through the lawsuit that the operator during a previously started proceedings on the merits would reimburse the postal retailers under the rules of 1 July.
VVP finds that TNT could not reduce tariffs for retailers, as this could cause a serious decline in revenue and even bankruptcies. The association believes that it is tariff reductions of 25 to 40 percent.
PostNL contradicts this. The company stressed that this income for the retailers only complement the income from the sale of the own product range.
Insufficient plausible
“In order to determine which of the parties is right, further investigation or evidence necessary, “the court ruled. “For this, the interim procedure has no place.” The alleged decrease in turnover is currently “sufficiently plausible”.
VVP also insufficiently substantiated by the judge that there really is a risk of bankruptcy for mail retailers. Also taken into account that 99 percent of the post retailers agreed to the revised remuneration model and still collaborates with PostNL.
Shame
“It’s a pity that the court did not consider the substantive assessment of our arguments “, says chairman Gerard Wezenbeek of VVP. “Retailers with PostNL point a lot of work for TNT. It is really ridiculous that PostNL expects to reduce this work allowance to 40 percent.”
The main proceedings which SCP has filed against PostNL is still going on. “This offers more opportunities to the objections to the practice of treating PostNL,” Van Wezenbeek.
The board of VVP is considering at this time on other actions and measures. Of Wezenbeek also hopes that the association again soon can engage with PostNL.
Annoying
“We are sorry to step into the court was needed. The order is always annoying together in front of the court, “said a spokeswoman for PostNL. “Just because we attach so much importance to good relations with all the retailers we work with.”
The spokeswoman stressed that the postal service has made the rate instruction “deliberate”
