The Authority Consumer & amp; Market (ACM) has gotten a rap over the knuckles because it blocked a proposed acquisition in 2012 of biscuit brand Scoop by bakery group Continental Bakeries from Dordrecht. The Board of Trade and Industry (Tribunal) overturned that decision Thursday due to poor support.
The ACM held the deal against, because it feared that the price of rusk would rise otherwise. Ball and Continental Bakeries, which makes include private label biscuits, would hold too high a share together. But according to the commission, the competition watchdog never made hard Sphere effectively competed with the brands.
Sphere came later, in 2013, in the hands of his German rival Borggreve. The decision of the Tribunal may still be relevant in claiming damages.
