Heavy defeat for layoffs director Erbudak in lawsuit – Parool.nl

The Enterprise is part of the Amsterdam Court and bends over conflicts within companies. In October 2013 Erbudak and her children were in an interlocutory decision yet on almost all fronts alike. Shares in the hospital were still almost entirely owned by the family Schram, but came on the orders of the Enterprise to an independent party under management, during an investigation into possible mismanagement from the two limited companies who had control over the Slotervaart. The driver of both private limited companies, Pim Schram, was suspended.

Those measures this afternoon reversed the judgment of today with immediate effect. This will put an end to the power struggle for the hospital.

Erbudak in 2006 director of the Slotervaart Hospital, which was then taken over by Jan Schram, who had built a million power with land market. Schram died in late 2012. According to the statutes, the heirs Schram had to offer to sell their shares in the hospital Erbudaks children. That happened only after the family Schram for five million euros was spent on additional shares, bringing the importance of family Erbudak of 49 percent diluted to virtually zero and acquire a majority stake was impossible.

Almost simultaneously Erbudak was dismissed with the consent of the heirs Schram. The initially unsuccessful negotiations with health insurer Achmea on a new contract were put forward as the main reason.

According Erbudak was the issue Achmea just an excuse to put her side. They filed a case to reverse the share issue.

Understandably
The Enterprise justifies the share issue, because Erbudak would have made it impossible for itself in key parties such as Achmea, where two thirds of patients in the Slotervaart is assured, the neighboring Antoni van Leeuwenhoek Hospital, her own medical staff and the council. The judges called a “disruptive role” of Erbudak and call it “understandable” that the family Schram wanted to marginalize its position.

That wish was partly due to the discovery of embezzlement by Erbudak, where the Public Prosecutor investigation since last year performed. These things they civil court against two convictions already been approached. The court ordered her to pay back early this year 1.7 million at the Slotervaart Hospital, partly due to submitting false invoices. Previously, she was ordered to repay 2.5 million euros to a company largely owned by the family Schram.
