Ten Hungarian truck drivers are entitled to back wages of a Brabant transport. The court East Brabant today decided that they should be paid to Dutch-based employment. The height of the back pay – the drivers demanded together more than 1 million – has yet to be determined

The Hungarians were flown in from Budapest and reason for years rides for transport van den Bosch from Erp, Netherlands as well as. from the Netherlands to other countries. According to Van den Bosch were the drivers under contract with a Hungarian sister company and they were therefore paid to Hungarian conditions. The drivers claimed that they were hired by the Dutch company and therefore had to be paid to the Dutch collective agreement.

The district judge ruled that the Dutch basic conditions apply both the Netherlands is the country from which temporary work and the Netherlands the country from which is usually worked. This is the case with the Hungarian drivers. The transport company had the Hungarians have to pay Dutch wage, so they now claim back wages.

For whatever the amount is, is still unclear because the claim for payment of the drivers is not complete. Both parties can currently submit documents to the court.

According to the court, the drivers were although in the service of the Hungarian sister company. Their claim that their dismissal would be reversed is therefore rejected; the company could dismiss them. The court rejects the reasoning of the drivers that the Hungarian company would have a payroll structure down. The drivers have their dismissal also challenged by the Hungarian court
