E-book shop Tom Cabinet should stop the offer for sale of used e-books through his website. That the Amsterdam Court decided today. According to the court, there is a wrongful act, as can be sold through the online service of Tom Cabinet illegally downloaded e-books.
The case was brought by the Dutch Publishers Association (NUV). Tom Cabinet uses the condition that offered material must be purchased legally and that the seller be removed as soon as the e-book is bought. But that is not adequately controlled by the publishers.
Earlier, the judge Tom Cabinet have the benefit of the doubt, because the judiciary is no clear distinction between paper and digital books.
But the court finds that NUV does have a point. Tom Cabinet must cease its activities, unless the company is still unable to take effective measures to exclude illegally obtained e-books from his website. For lifting the ban will Tom Cabinet then have to return to the judge.
